Automobile accidents caused by drivers operating a motor vehicle while under the influence of alcohol, illegal drugs or prescription medications (DUI) are responsible for the death of an American every thirty minutes of every day.

A Bitter (Orange) Pill to Swallow?

New Weight Loss Supplements Still Have Heavy Consequences
By Farrest Taylor, Esq. and Catherine Walding, Legal Editor

In a country where obesity is an ever-growing problem, the dieting industry is selling a mouthful of dangerous products. Consumers spend a staggering $20 billion each year on dietary supplements in the United States, despite recurring evidence of the dangers of such products when sold over the counter.

Specifically, research conducted by the U.S. Food and Drug Administration confirmed that diet drugs containing ephedra and ephedrine-alkaloid were found “to raise blood pressure and otherwise stress the circulatory system,” possibly causing myocardial infarction, stroke, seizure, cerebrovascular accidents, and/or sudden death. Due to these findings, the FDA banned ephedra and ephedrine containing supplements from unregulated use in 2004.

The result? Synephrine, a derivative of a citrus fruit known as Bitter Orange, Sour Orange, or Zhi Shi. With a molecular structure very similar to ephedra, synephrine is the new chemical of choice for dietary supplements, and manufacturers of supplements containing synephrine claim that they, like those formerly containing ephedra or ephedrine, will also burn fat, increase energy levels, increase metabolism, and promote weight loss. Unfortunately, it appears that the negative side effects of the new supplements are very similar as well. Though not well documented, it is becoming more evident with time that synephrine can be associated with adverse cardiovascular events. A tragic example of this evidence comes from the Texas Heart Institute Journal, which reports a case of a previously healthy 24-year old male who presented to Walter Reed Army Medical Center with a severe myocardial infarction just hours after ingesting a dietary/performance enhancing supplement. The man, who had been using the supplement to enhance to his daily workouts, had no preexisting cardiovascular issues, family history, or history of drug use. He had, however, been taking the supplement, which contained synephrine.

Given the close molecular structure and the growing evidence as to the detrimental effects of supplements that contain synephrine, it is imperative that the FDA involve itself in the regulation of such supplements

Wrongful Death in Birmingham, Alabama

A "wrongful death" occurs when an individual dies as a result of the negligence or misconduct of another person, company or entity. Pursuing a wrongful death claim for financial compensation can never replace the loss of a loved one, but it will provide for lost income, medical and funeral expenses and the pain and suffering caused by the finality of your loss.

Wrongful deaths can be the result of medical malpractice, fatal car or truck accidents, construction fatalities, deaths caused by defective products or defective drugs, drowning or fire-related deaths and those killed as the result of a violent act. Losing someone you love is heartbreaking, but when that loss was avoidable and caused by the negligence or misconduct of another, the loss somehow seems more difficult to endure.

The only method available for measuring the cost of the loss of a loved in a court of law in a wrongful death case is by determining the financial loss that the death caused to the victim's survivors and beneficiaries.

When that loss is measured, the money the deceased earned, could have earned had they lived and how financially dependent the survivors were on the support of the deceased is taken into account. Medical, burial and funeral expenses are also taken into consideration.

Please contact the Birmingham, Alabama office of The Cochran Firm today if you have lost a loved one to a wrongful death to schedule a confidential consultation at no cost to you to protect your legal rights and get you the financial compensation you so rightfully deserve.

Police Brutality in Birmingham, Alabama

All law enforcement officers take an oath and promise to serve and protect. At times in the course of carrying out their promise, the excessive use of force, false arrests and similar forms of abuse of power enter into the equation.

Police brutality refers to any inappropriate use of force out of proportion to the situation or threat posed by another person to the police. Some examples include injuring or killing an individual by unwarranted use of a firearm or arresting someone without reasonable suspicion or probable cause. The overuse and misuse of stun guns by law enforcement is a growing concern in communities across the country.

The use of force by the police is definitely required in certain situations, but there is no denying there are times when a few police officers step over the line and use their authority to do harm to an undeserving individual. Many cases of police brutality go unreported and can include instances of racial profiling, sexual harassment and intimidation and corruption.

If you live in Birmingham, Alabama or the surrounding area and you feel you have been the victim of police brutality, please contact the experienced attorneys at The Cochran Firm today to protect your legal rights and learn what you can do to fight police brutality and obtain justice for yourself and make your community a better place to live at the same time.

Automobile Accidents/Rear End Collisions in Birmingham, Alabama

There are over 2.5 million rear end collisions nationwide annually, making rear end collisions the most common type of automobile accident. The bumper system on a car is an important safety feature that is capable of absorbing the force of a low speed collision, but at times the impact of the collision is absorbed by the occupants of the automobile instead.

A low speed, rear impact collision, although resulting in minor damage to the automobile, can result in serious injuries to the occupants of the vehicle. Whiplash is the most common injury sustained in a low impact rear end collision and is the result of a sudden, violent, and involuntary back and forth motion of the neck. Whiplash is soft tissue trauma to the muscles and ligaments of the neck that results in pain, swelling, stiffness, headache, nausea, numbness and loss of balance.

If you or someone you know has been injured in a rear end collision car accident you should protect your legal rights by consulting with a rear end collision car accident lawyer who has experience in this field of law. You deserve to be financially compensated for your medical expenses, lost wages and possible loss of future income, due to the injury you have suffered because of someone else's negligence.

Please contact the Birmingham, Alabama office of The Cochran Firm today and learn how to obtain the financial compensation you are entitled to for the injuries suffered in a rear end collision.

Birmingham Cop Arrested for Sodomy and Sexual Abuse

A Birmingham police officer was charged with sexual assault and sodomy. The 20-year-old female victim filed the charges against the officer who was on duty when the alleged assault took place.

With sexual harassment already a significant problem in the workplace, it is intolerable to think that citizens are subject to this form of assault from those who are sworn to serve and protect us from such victimization. This goes beyond police misconduct and municipal liability, violating not just citizens’ rights, safety and well-being, but also their trust and support for civil service agencies.

Another example of police brutality occurred just days later when police arrested several peaceful pro-life supporters, members of the Survivor’s Campus Life Tour, for handing out literature to high school students as they were dismissed from school. Although the pro-life advocates remained on public sidewalks police told them that it was not public property for non-Birmingham residents.

They were arrested on charges of trespassing, though no penal codes were stated on the bond forms that were given them, and no citations were issued. The group claims that their individual rights of free speech and civil rights have been violated, and especially violated were those rights-to-life of unborn children on whose behalf they were speaking. The advocates pointed out that, “those charged with upholding the law are, in fact, the ones that violated the Highest Law of the land today." Several YouTube videos were posted showing the peaceful nature of their mission in handing out leaflets to the students and how the police treated them during their arrests.

Animal Attacks and Personal Injury Claims

A recent dog attack in Birmingham injured a 13-year old boy while he was tossing a football with several friends. An unrestrained pit bull attacked him, biting him on his right arm and inflicting wounds severe enough to require stitches. Animal Control Officers placed the dog in quarantine after the boys identified it as the one that attacked. The dog’s owner commented that there are several dogs that roam the neighborhood that look like the one that attacked the boy.

The attack by an unrestrained animal is typical of the type of negligence that could lead to a personal injury claim against an animal’s owner. Pet owners are responsible to keep their animals under control at all times. They are also responsible for any damage or personal injury their animal causes.

Despite owners’ responsibilities, there might be circumstances that spread the responsibility to others. In the recent case where a chimpanzee attacked its owner’s friend, questions are being raised about why animal licensing officials didn’t ensure that this primate was registered as required by law. Would this have made a difference? Only a thorough investigation can make that determination.

On the other side of the country, a settlement was reached in the December 2007 case in which a 17-year old killed by a Siberian tiger that escaped its enclosure at the San Francisco Zoo. The zoo’s insurance company will pay the full undisclosed amount to the family.

The two boys who survived that attack also filed suit, but their cases are still in litigation. Although the enclosure met the required specifications and dimensions to confine a “big cat” the fact is that it failed to keep the tiger contained, exposing the zoo to a premises liability claim.

The Cochran Firm, with offices throughout the United States has personal injury attorneys who are experienced in investigating and settling cases involving personal injury claims. If you were injured due to someone’s failure to keep their animal confined, please contact the personal injury attorneys at The Cochran Firm in Birmingham, Alabama for a consultation and case review.
