Defective Toyota Vehicles and Car Accidents in Chicago, Illinois

Family Files Wrongful Death Suit against Illinois Theater

An Aledo, Illinois family has filed a wrongful death lawsuit against the owners of Great Escape Theatres for the 2007 death of a 50-year-old woman. The spouse and children of the deceased are suing Great Escape Theatres, Alliance Entertainment, and Ragains Enterprises, as well as the architect firm that designed the theater.

In July 2007, the victim slipped and fell at the movie theater breaking several bones. She died a few days later after developing a blood clot which traveled to her lungs. The suit alleges the injuries suffered in the fall caused the clot which killed her.

The lawsuit states the design of the theater's entrance, which includes ceramic tiles next to each studio in the theater, is defective. The tiles are not slip-resistant, and the suit claims this, as well as failure to clean up spills. The ceramic design is used in these theaters to keep spills off the theater carpet and make clean up easier.

The husband and grown children of the victim are seeking more than $50,000 in damages.

Chicago Police Use Excessive Force to Remove a Man from a CTA Bus

Although many people claim, falsely, to be victims of police brutality, there are cases where one or more officers use far more force than the situation calls for. In a recent case, an officer was called to remove a seemingly intoxicated man from a Chicago Transit Authority bus for not paying his fare.

Video clips placed on news websites, YouTube, and other sites showed the officer screaming obscenities at the man, baiting the man by yelling repeatedly, “Do you want to fight?” The video shows him punching the man, slamming his head against the window several times and becoming so violent that passengers on the bus moved to the back of the bus, putting plenty of room between the officer and themselves.

It wasn’t until after the officer had done all of these things that he called for assistance. In less than a minute, another officer arrived to assist him in removing the man from the bus, which proceeded quickly and without incident at that point. The man remained passive throughout the violent assault and went rather peacefully when the second officer arrived.

Incidents such as this are more common than we would like to believe. It was only a few weeks ago that a man was shot and killed at a BART station in Fruitvale, California by one officer, even though three other officers restrained the victim.

In another incident a Chicago man was shot in the back by police, who claim the victim threatened them with a gun.

Pharmaceutical Companies Seek Federal Immunity to Lawsuits

In a growing trend to protect itself from lawsuits against pharmaceutical companies, Wyeth Pharmaceuticals has brought a case before the U.S. Supreme Court asking to prohibit consumers who have suffered from adverse reactions, injury or death caused by medications from filing suit for damages. Essentially, the pharmaceutical companies and device manufacturers are falling back on FDA approval as their defense. They seem to want to hide behind the idea that if the FDA says it’s OK the manufacturers should not be liable when their products fail to work or prove to be dangerous in real-world conditions.

If the Supreme Court rules in favor of the pharmaceutical companies, no American in the country will have the right to compensation. Manufacturers’ obligations to provide safe products may be the one factor that encourages them to produce high quality products. In the absence of liability, manufacturers will have little incentive to ensure the safety of their products.

Currently, Michigan’s 1995 law protecting manufacturers by prohibiting victims of unsafe drugs from seeking compensation is the only one of a similar kind in place, to date. Georgia is currently holding hearings on a similar law to protect manufacturers from product liability claims. But if the U.S. Supreme Court decides in favor of the manufacturers, it will become effective nationwide, placing all Americans at risk without recourse.
