$4.75 million Verdict in Shoulder Pain Pump Defective Product Lawsuit
Last week, an Oregon jury ordered I-Flow Corp to pay a man $4.75 million for the postarthroscopic glenohumeral chondrolysis (PAGCL) that destroyed cartilage in his shoulder after he used the company's pain pump. The jury found that the company, now a subsidiary of Dallas, Texas-based Kimberly-Clark, encouraged surgeons to use the pump in an unapproved manner that it had reason to believe was unsafe.
According to the verdict, the company encouraged surgeons to use the pump for delivering pain medications directly to the joint space, even though it had never been approved for that use. The Food and Drug Administration (FDA) issued a statement in November stressing that neither the pump nor the medications it infused had been approved for long-term delivery directly into the joint. The FDA's statement came after a thorough review of dozens of cases of PAGCL, 97% of which affected the shoulders.
This verdict represents the first successful defective product verdict against pain pump manufacturers, who face hundreds of lawsuits across the country. Last year, attempts to consolidate the lawsuits were rejected because so many different pain pumps have been targeted by plaintiffs. In addition to I-Flow, numerous pain pump manufacturers have been implicated in lawsuits.

Truck Accident Victims Awarded Millions
Mary and John Reutter had slowed down because of traffic on Interstate 35W in Burleson, Texas but didn't see what had not slowed down behind them. A tractor-trailer slammed into them, sending their 2002 Ford Mustang into the vehicle in front of them.
The Reutters suffered major injuries - and are still recovering two years after the June 16, 2006, crash - but they settled with the truck's owner, United Petroleum Transports, recently for $5.5 million.
The wreck left Mary Reutter's left arm paralyzed and cost about $500,000 in medical expenses, an attorney for the couple said. The Reutters moved to Michigan and have been trying to put the pieces of their lives back together. In addition to Mary Reutter's incapacitated left arm, she only has 40 percent mobility in her right arm, making it nearly impossible to take care of herself.

Report Says Texas Medical Malpractice Reforms Discriminate
Four law professors, three of them from the University of Texas law school and one from the University of Illinois, released a study citing evidence that caps on non-economic damages medical malpractice cases are discriminatory in the state of Texas. Because of the caps, cases won by the plaintiff saw their damages reduced 47% of the time. It was found that the cases that had most of the damages reduced involved the unemployed, the elderly, and the deceased. It is believed this is so due to the groups do not have lost wages to “prop up” their claims.
If a jury found that there was enough evidence to show a medical professional acted in a negligent way, and the jury has determined what that plaintiff deserves in compensation, then one would think that all the money would get to them. However, 30 states have caps on medical malpractice claims, so it isn’t just Texas. But the study found that when there is a death involved in a Texas medical malpractice case, the elderly, unemployed, and the surviving children have their compensation limited to non-economic damages.
Fully compensating injured parties, especially those who have no other recourse, like the elderly, but especially the children, should be an important step and a concern of each and every state. If, as has been suggested in the study, and elsewhere, caps are keeping some attorneys from accepting medical malpractice cases from these groups, it can be argued that justice has not been served.

Cardinal Health 303, Inc. Not in Compliance with Current Good Manufacturing Practices
The company was in the process of making corrections when QS deviations in another line of their infusion pumps were found. These deviations included, among others, a failure to notify the FDA, timely, of a malfunction that could cause or contribute to a death or serious injury if it recurred, and failure to develop a system to investigate complaints of malfunctions or failures. The FDA then sought amendments to the original decree to include all of the company’s infusion pump lines.
In a February 2009 news release Cardinal Health signed an amended decree to correct the violations of cGMP in the production of all of their infusion pumps. The amended decree adds requirements for the company to submit a corrective action plan for bringing all pumps being used in the United States into compliance with the Federal Food Drug and Cosmetic Act. They are also to retain an independent expert consultant who will inspect all of their infusion pump facilities and their recall procedures. The consultant will certify to the FDA that all required corrections have been made.
Once this level of compliance has been reached, Cardinal Health 303 is to hire an independent auditor to make annual inspections of all of its infusion pump facilities and report to the FDA its findings for four years. If future violations are found, the FDA is authorized to order Cardinal Health to cease manufacturing and distributing it products, and to recall all products, impose stiff fines and take other actions.
Additional Reporting Requirements
The 1990 Safe Medical Devices Act (SMDA) required device-using facilities to report malfunctioning equipment and failures that could cause or contribute to a death or serious injury if it recurred, to either the manufacturer or the FDA (or both) per circumstances specified in the SMDA. The SMDA also imposes a duty on the facility using the equipment (e.g., hospitals) to isolate and report defective equipment within a specified period of time.
This means that manufacturers will be notified by any facility that experiences a malfunction, and they, in turn are required to report the malfunction to the FDA. Under certain circumstances, the user is to report to the FDA in addition to the manufacturer. The manufacturer has no reason not to be aware of malfunctions or failures of their equipment.
The SMDA also holds the individual operator (e.g., nurses, doctors) personally responsible to report faulty equipment to a designated person within the facility, and imposes penalties of fines and imprisonment for failure of either the individual operator who discovered the malfunction or the facility’s designated contact to report the event.

On a scale of 1-star being the lowest score, to 5-stars being the highest, non-profit nursing homes received a higher proportion of 5-star ratings than did for-profit homes, and for-profit homes received a higher proportion of 1-star ratings, 27% compared to 13% of non-profit homes.
Nearly one-fourth (23%) of all nursing homes in the US received a 1-star rating. Only six states can claim that 20% or more of their nursing homes received a 5-star rating. A total of 33 nursing homes across the country received the 5-star rating. The remaining states and Washington D.C. had fewer than 20% of their nursing homes rated as 5-star quality.
Texas was 44th with 28.6% of its nursing homes scoring 1-star, and 43rd with only 9.4% of its nursing homes scoring 5-star ratings. With the baby-boomers rapidly increasing the need for nursing home care, this is a dismal outlook for many who expect to have at least decent care should they need to live in a nursing home. These low results indicate a significant potential for neglect or abuse.
