Death, Serious Injury in Michigan Boating Accident

Labor Day weekend saw many Michiganians decide to take their boats out on the water for the semi-official end to the summer season. Unfortunately, with many boats comes an increased risk of boating accidents, especially when teens are in control. On Saturday night, 8 teenagers were boating in Stahl's Bayou, an inlet off Spring Lake, attached to Lake Michigan by the Grand River when their vehicles collided. Three of the teens were riding a personal watercraft that was struck by a motorboat carrying the other five teens. The accident led to the immediate death of the watercraft driver. One of the passengers was transported to a nearby hospital, having lost a leg in the crash.

Although alcohol was not a factor and it is not known whether charges will be filed, the accident might have been due to reckless boating. The teens knew each other. The place where the vehicles collided is nicknamed "Hanky Panky," and has a reputation for thrill-seeking boaters performing dangerous maneuvers.

Michigan Debating a Repeal of Law Preventing Pharmaceutical Liability Lawsuits

For the last 13 years, Michigan residents have been unable to sue drug manufacturers for damages when their defective pharmaceutical products cause serious injury. In 1995, the state passed a law shielding pharmaceutical companies from product liability lawsuits if the drug was approved by the Food and Drug Administration (FDA). Under this law, the drug manufacturers must have truthfully represented all of the research about the drug to the FDA in order to receive immunity from lawsuits.

The Michigan legislature passed this law in the belief that it would help bring pharmaceutical companies to Michigan, thereby creating many jobs for the state’s struggling economy. However, the law has not produced its desired results. In recent years, many pharmaceutical companies have actually moved their operations out of Michigan to states that did not have similar immunity laws.

There is an obvious ethical question associated with this law. Is sacrificing the rights of injured victims acceptable to create new jobs? The many Michigan residents who have been unable to receive fair compensation for injuries caused by the negligent actions of pharmaceutical companies most likely do not feel that it is acceptable. How can a state reasonably justify placing corporate profits and the creation of jobs over human rights?

Recently, Michigan Democrats have proposed a bill that would repeal this law. If it passes, Michigan residents would once again have the ability to hold drug manufacturers accountable when their products inflict serious injury on unsuspecting consumers. However, this bill faces strong opposition by state Republicans, and it is uncertain whether it will pass.

Interestingly, Michigan’s immunity law was not affected by last month’s U.S. Supreme Court ruling in Wyeth v. Levine, which stated that pharmaceutical companies should not be protected from lawsuits under the doctrine of preemption.

It will be interesting to see how this bill plays out in the Michigan state legislature. This bill carries high stakes for many people on each side of the debate.

Oklahoma Police Report Pro-Lifer to U.S. Secret Service Agency

An Oklahoma City police officer pulled Hal Harrison over and confiscated a sign he’d made and placed on his truck, telling him it could be construed as a threat against the President. Harrison merely wanted to encourage support for the unborn, and discourage support for any legislation the President may sign that supports or encourages abortion. It’s a matter of free speech, but a poor choice of words. The sign said, “Abort Obama, not the unborn.”

After a police supervisor reviewed the situation, they returned the sign to Harrison having concluded that the officer had been “overzealous.” Despite the confiscation being excessive, the police captain stands behind their decisions, both to pull Harrison over and to report him to the Secret Service.

Adrian Andrews of the Secret Service in Oklahoma City interviewed Harrison at his home. While there, they also conducted a search of his home. In the end, they decided that he was not a threat.

Harrison still has the sign on his truck and is considering a civil suit for violation of his free speech rights, if he can find a lawyer to take his case.

Jury Upholds Award to Female Prisoners Sexually Abused by Guards

In 2008, a Michigan jury decided in favor of ten female prisoners who claimed to have been sexually abused during the 1990s by prison guards employed by the Scott Correctional Facility. They were awarded $15.5 million in damages, and many more cases are yet to be decided. The Michigan Department of Corrections lost their appeal in January 2009 but says it will likely appeal to the Supreme Court.

The case is part of a class action suit filed in 1996 involving more than 500 female inmates claiming sexual abuse by prison guards in Michigan prisons. According to Deborah LaBelle, the women’s’ attorney, this ruling, "reaffirmed the basic human rights of women in prison not to be sexually abused by state employees."

The apathy of many involved in this case is an indicator that little will be done to prevent its recurrence. One juror commented, "What happened is a terrible blot on the reputation of the State of Michigan." While this is true, is it really the primary issue? There seems to be no concern for the women who suffered from the abuses of state employees.

Deborah LaBelle also pointed out, "Neither the Department of Corrections nor the Attorney General's office, which is the head prosecutor in the state, believes they have an obligation to report or pursue criminal acts that occurred in a state facility." In fact, several of the allegedly involved guards who are still employed have been promoted, despite the potential breach of duty.

The women said that they were afraid to use the official reporting procedures at the time of the incidents due to fear of retaliation, which took the form of verbal or physical abuse, excessive searches, or fabricated disciplinary actions placed in their files that affected their credibility at parole hearings. Prisoners who made allegations were segregated “for their own safety,” and not allowed to attend classes or other programs.

The procedures further required that they tell the person, whom they were reporting for sexual abuse, that they intended to file a grievance. To make matters worse, some of the accused guards were assigned to investigate themselves. Prisoners’ accusations were not considered credible, while the employee was presumed to be credible.

Detroit Hit and Run Leaves Child Fighting for Her Life

A family was driving on Tuesday morning when they became victims of a hit-and-run auto accident. The family of four, including mother, father, and two daughters, aged 9 and 16, were headed toward school when a joyriding teen in a stolen vehicle (that had been left running and unlocked) struck them, then continued on. The teen then abandoned the stolen vehicle and climbed into a getaway car.

The two children suffered serious injuries.The 16-year-old has been upgraded to good condition, but the 9-year-old, who suffered spinal injuries, remains in critical condition.

Although the hit-and-run driver is of course mostly responsible for the children's injuries, there is someone else who is to blame. When the teen driver struck the family's Kia Sorrento in the driver's side rear quarter, the SUV should have protected the family. But this class of automobiles is notoriously defective when it comes to side and rear impacts. According to the Insurance Institute for Highway Safety, many SUVs, which should be good at protecting families, are actually only marginally effective against side and rear impacts, and the Kia Sorrento was actually rated "Poor" in 2008.
