Houston Bus Drivers to Be Fired For Texting and Driving

The Houston, Texas Metropolitan Transit Authority has decided to fire any bus driver who is caught texting behind the wheel. The decision was made in July, after a bus driver in San Antonio caused an accident due to cell phone use. The driver was captured on a security camera looking at his cell phone for several seconds, then looking up to slam on the brakes, too late to prevent hitting two stopped cars in front of the bus. The Houston METRO had received over 300 complaints since January 2008 that drivers were using cell phones while driving. In addition, several recent crashes in transit systems have called attention to transit safety. A September 2008 train crash in Los Angeles and the June 22 Metro Crash in Washington, D.C. are two of the most familiar events.

As calls from environmentalists and city authorities ask people to leave their cars at home and rely on transit for transportation to and from work, transit authorities do need to step up measures to ensure that public buses and trains are safe for riders. The Houston METRO policy can be a guideline for other transit authorities. METRO employees are being forced to turn over their personal phone records when a complaint is received, and those records are being checked to see if texts were sent or calls made while the bus or train was in motion.

Truck Accident Victims Awarded Millions

Mary and John Reutter had slowed down because of traffic on Interstate 35W in Burleson, Texas but didn't see what had not slowed down behind them. A tractor-trailer slammed into them, sending their 2002 Ford Mustang into the vehicle in front of them.

The Reutters suffered major injuries - and are still recovering two years after the June 16, 2006, crash - but they settled with the truck's owner, United Petroleum Transports, recently for $5.5 million.

The wreck left Mary Reutter's left arm paralyzed and cost about $500,000 in medical expenses, an attorney for the couple said. The Reutters moved to Michigan and have been trying to put the pieces of their lives back together. In addition to Mary Reutter's incapacitated left arm, she only has 40 percent mobility in her right arm, making it nearly impossible to take care of herself.

Defective Roadway May Have Contributed to Woman's Death in Houston Flood

A Houston, Texas driver is missing after her car turned off Beltway 8's southbound frontage lanes near the Katy Freeway. A witness saw the dark-colored sport utility vehicle turn off the roadway directly into the ditch, and suspected that the driver, believed to be a woman, was attempting to turn onto a side road. The accident occurred at about 4:30 am, and at the time of this writing, police divers had not yet been able to reach the driver. The car is under several feet of water, and police divers have been very cautious about heading into the rushing current. They have been exploring the entire 1-mile length of drainage conduits that run the width of the Katy Freeway.

This is not a typical car accident. There are several aspects of this tragedy that point to defective roadway construction as a factor in the driver's probable death. If side streets were all more clearly marked, the driver would have been less likely to mistake the drainage ditch for a road. In addition, an effective barrier at the ditch should have stopped a car at likely turning speeds. Either one of these minor modifications could have prevented this wrongful death.

Report Says Texas Medical Malpractice Reforms Discriminate

Four law professors, three of them from the University of Texas law school and one from the University of Illinois, released a study citing evidence that caps on non-economic damages medical malpractice cases are discriminatory in the state of Texas. Because of the caps, cases won by the plaintiff saw their damages reduced 47% of the time. It was found that the cases that had most of the damages reduced involved the unemployed, the elderly, and the deceased. It is believed this is so due to the groups do not have lost wages to “prop up” their claims.

If a jury found that there was enough evidence to show a medical professional acted in a negligent way, and the jury has determined what that plaintiff deserves in compensation, then one would think that all the money would get to them. However, 30 states have caps on medical malpractice claims, so it isn’t just Texas. But the study found that when there is a death involved in a Texas medical malpractice case, the elderly, unemployed, and the surviving children have their compensation limited to non-economic damages.

Fully compensating injured parties, especially those who have no other recourse, like the elderly, but especially the children, should be an important step and a concern of each and every state. If, as has been suggested in the study, and elsewhere, caps are keeping some attorneys from accepting medical malpractice cases from these groups, it can be argued that justice has not been served.

Texas City Refinery to Spend $180 Million to Correct EPA Violations

In 2001, BP Products North America, Inc. signed a consent decree with the Environmental Protection Agency. In 2005 a devastating explosion and fire at their Texas City, Texas refinery killed 15 people and injured over 170 people. The investigation of this explosion revealed that BP Products was in violation of its 2001 consent decree and felony violations of the Clean Air Act.

In February 2009, BP Products agreed to spend nearly $180 million to clean up its operations and stop putting public health at risk. There is a high population of low income and minority people in this area.

The EPA violations to be corrected at the Texas City, Texas plant include:

• Limiting emissions of stratospheric ozone depleting hydrochlorofluorocarbons (HCFCs) from leaking industrial and commercial cooling appliances. These will be retrofitted to use non-ozone-depleting refrigerants.

• Improving oversight and management of asbestos-containing wastes generated during routine renovation and demolition activities. Asbestos can cause asbestosis, lung cancer and mesothelioma.

• Reduce air pollution from diesel vehicle emissions in Texas City and the surrounding area. Benzene is a hazardous air pollutant, known to cause a number of acute and chronic health effects, including cancer, nerve and immunity impairment, and adverse reproductive and developmental effects.

Two Drug Manufacturers Sued by US for Promoting Drug for Unapproved Use

The Food and Drug Administration (FDA), responsible for approving drugs for prescription use, does so, allowing specific uses. Among the provisions for approving any drug is a list of specifically permitted uses. These are uses for which the drugs passed a series of clinical trials, and documented results are evidence of their safety and efficacy under the tested conditions. When a company applies for FDA approval it must state the intended uses for that drug in its application. The manufacturer must not market or encourage any other uses of the drug.

After an investigation by the Civil Division of the U.S. Department of Justice, the U.S. Attorney’s Office for the Northern District of California, the Federal Bureau of Investigation, and the Offices of Inspector General of the Department of Health and Human Services, the FDA, the Department of Veterans Affairs, the Office of Personnel Management, and the Department of Defense, Johnson & Johnson, Inc. and its subsidiary, Scios, Inc. were sued by the United States Government for off-label use of the drug Natrecor.

The stated use for Natrecor is “the intravenous treatment of patients with acutely decompensated congestive heart failure who have dyspnea [shortness of breath] at rest or with minimal activity.” Natrecor’s 2001 FDA approval was based upon studies in which the drug was administered by intravenous infusion over a 36-hour period to a specified populations having severe heart failure with specific complications.

Scios, however, began aggressively marketing Natrecor for scheduled, serial outpatient infusions, and for patients whose heart failure was less severe than the population indicated in the drugs’ FDA application. This use is not included in the FDA-approved label, thus is considered an off-label use.

Medicare doesn’t cover off-label use of drugs, with the single exception being when such use is medically necessary. Because leading cardiologists told Scios that it should not promote the off-label use, along with a 2007 study that showing that there was no significant benefit to the serial outpatient infusions, Scios notified healthcare providers of its findings.

Two former sales employees notified the FDA of the off-label marketing in a whistle-blower report, bringing it to the attention of the federal government. Patients are assured of safe medical care and the right to medications prescribed based upon proven and safe outcomes by the Federal Food, Drug, and Cosmetic Act.

While this is a case that is not known to have caused physical or mental personal injury or death to any patient, it is a matter of fraud, Medicare fraud, and deceptive practices.
