Southwest Airlines Faces Personal Injury Lawsuit over "Fume Event"

On January 27, 2009, a Boeing 737 operated by Southwest Airlines lifted off in Los Angeles. About an hour into flight, several of the passengers began having trouble breathing. The crew was informed that the air quality in the cabin was poor. In response, the pilot engaged the engines at full thrust and climbed the aircraft. The intent of this maneuver is unknown, but the effect was to send super-heated air through the ventilation system, bathing the passengers in hot, contaminated air. A mist hung in the cabin, and several passengers began to experience problems, so the plane was forced to make an emergency landing in Albuquerque, New Mexico. Two sisters who were among the passengers now claim to have suffered disabling neurological injury and respiratory symptoms and have filed a personal injury lawsuit against Southwest Airlines.

This lawsuit is one of the most recent occurrences of what are known as "fume events," where dangerous chemicals are blown into the cabin of aircraft as a result of a malfunction in the aircraft's ventilation system. Ventilation systems need some way to replenish oxygen. Most commonly, this is done by introducing fresh air from the outside. In the case of airplanes, the fresh air is taken from the engines. However, when a malfunction occurs, chemicals from the engine, including tricresyl phosphate, a known neurotoxin in its tri-o-cresyl phosphate isomer, may blend with the cabin air, creating a toxic environment. Often, the level of contamination is below what is considered a toxic level, but some individuals may be more susceptible than others.

The toxicity of tricresyl phosphate and related compounds has been known since 1977. Airline fume events are common to all airlines and involve all makes and models of airplanes currently in service. A British study said that these events occur in about 1 out of every 2000 flights. A National Resource Council study of Canadian aircraft showed that on at least one model of aircraft fume events may occur as frequently as four times out of a thousand flights. With millions of flights a year, even 1 out of 2000 flights means that there would be over a dozen events every day. However, these events are not well-publicized. Although every such event is supposed to be reported, only 108 were reported in 2008, far below the expected level.

Defective Weight Loss Drugs in Los Angeles, California

Medical Malpractice: Hospital Exposes over 200 Patients to Dangerous Radiation

At one of the most famous hospitals in Los Angeles, Cedars-Sinai Medical Center, 206 patients were exposed to 8 times the normal dose of radiation during CT (Computed Tomography) brain scans. The patients were given scans over an 18-month period from February 2008 to August 2009 on a CT machine set to a higher dose than normally used. The report prompted the FDA (Food and Drug Administration) to issue a nationwide warning to hospitals to review their safety and quality assurance protocols for CT scans. Included is a basic reminder that dose indices are displayed on the control panel and that people performing scans should know what an expected dose should be.

During the 18 months that this machine was used at its elevated setting, more than one patient experienced signs of high radiation doses, including reddened skin and hair loss. It was the latter symptom which finally lead hospital officials to investigate the machine and discover it had been set to a higher dose.

As a result of the higher dosing, patients were exposed to as many as 4 grays of radiation to the head, instead of the expected 0.5 grays. A gray is a measure of radiation absorbed per kilogram. For comparison, a set of dental x-rays typically results in a brain exposure of 0.005 milligrays, or 0.000005 grays. A full-body exposure of 8 grays is considered lethal.

At this point, no medical malpractice lawsuits have been filed, but if they are, they will most likely be for what is known as hospital malpractice. In this type of lawsuit, an entire facility is held responsible because systematic errors by numerous persons contributed to the error. If any person during the 18 months that these 206 scans were conducted had actually checked the dosage, further patients could have been saved from dangerous radiation exposure.

When you undergo a CT scan, it is worthwhile to ask your doctor how much radiation you will be exposed to, and even to ask that they check the dosage on the machine. Also, you should look for signs of acute radiation exposure, including:

  • Nausea and vomiting: the closer to the scan, the higher the dose
  • Red skin
  • Headache
  • Fatigue
  • Fever
  • Hair loss
  • Bloody stool or vomit
  • Poor wound healing

Investigation Called For Into Fatal L.A. Shooting

Los Angeles County Sheriff, Lee Baca, has called for an investigation into an incident that occurred on September 14, 2009 in Athens, CA. Athens is an area just south of downtown Los Angeles.

The Events So Far Known
That night, there was an armed robbery in this area and sheriff's deputies from the Lennox station were looking for two suspects. They were near 120th St. and Budlong Ave. when they saw two men who matched the suspects' descriptions. According to Sgt. Diane Hecht, the deputies approached to speak to them but one of the men ran and the deputies chased him. When he reached into his waistband, a deputy fired at him, thinking him to be armed. By this time they were in the 1200 block of Poindexter St.

The man was hit in the upper body and was pronounced dead at a nearby hospital. He was one Darrick Collins, aged 36, who had apparently been playing a video game with a friend. He is reported to be the father of two and one of them, a daughter, lives in L.A. with her mother. The other child is a boy of 16 months whose mother is one Kendra Dean.

According to Sheriff's Lt. Dave Dolson, who spoke with reporters at the scene, the deputies called out to Collins to "Freeze!" but as the man then ran, they did not get to question him about the armed robbery. The Sheriff’s office is still looking into whether Collins might have been involved with the robbery.

The other man was not detained and no weapons have been yet found at the scene. So far there are no details available about the armed robbery. Collins' uncle, brother, and other family members are much grieved and angry at this sudden loss - perhaps a wrongful death.

An Expedited Investigation
The President of the Los Angeles Urban Policy Roundtable, Earl Ofari Hutchinson, will be meeting with Sheriff Lee Baca and various community leaders to discuss this incident. Baca has called for an expedited investigation. Usually such investigations take up to twelve months to complete, but Baca would like this one to be finished within 90 days.

Pending the investigation results, the true facts of Collins' death cannot be certain. It is well known that one should never run when a police officer wants to speak to you - it suggests guilt. On the other hand, Collins was apparently planning to attend barber school and could have been an innocent citizen mistaken for the suspect. Winnie the Pooh Bassinet Caused the Wrongful Death of Infants in Los Angeles

Tainted Water Bottles Sicken Kids at California Middle School

Twelve middle school aged children have been hospitalized after drinking water from bottles they got from a vending machine in Santa Clarita, California. Fire officials received reports that people were becoming ill at the school on Thursday afternoon. The children who became sick complained of cramps and headaches, and all were transported to nearby medical clinics. Along with local authorities, the FBI is investigating.

Though it isn't clear what was in the water to make those who drank it sick, it was cloudy and had a strange smell and could have been related to bleach, according to a county fire inspector. How it got in there is anyone's guess. The bottles do not appear to be tampered with, which indicates there could be a problem at the bottling plant.

However, the Pepsi Bottling Group, which owns Aquafina and the bottling plant, released a statement claiming there is no evidence that anything in their manufacturing process caused the illnesses. They examined and tasted other bottles that were produced at the same time, and conducted their own tests. The corporation believes this is an "isolated incident."

Until more tests are completed, there is no way of knowing what may have been in the bottles. One doctor has said this could possibly be a psychosomatic reaction of one child drinking water and becoming sick, and others who drank the water imagined they had the same symptoms. All children may imagine things, and some may overreact, but it is in the best interest of all to get to the bottom of this. If it turns out the water had some kind of toxin in it, the fact only 12 children were sickened may be a blessing.

Truck Accident in California Kills 2 and Injures 12

A truck transporting cars lost control coming off a highway and crashed into a bookstore in La Canada Flintridge, California. The truck careened through an intersection during rush hour, smashing several vehicles before coming to rest in the bookstore. A man and his 12-year-old daughter were killed when the truck ran over the car they were in, and twelve others were injured. Three people remain in critical condition. Besides the damage done to the bookstore, a wine store and nail salon were also damaged.

The highway the truck accident occurred on runs through the town near Los Angeles. Authorities have said the truck lost control as it was coming off the highway and could not make a turn. City officials in La Canada Flintridge have complained to CalTrans about the dangers of the intersection. After a collision involving a semi-truck that injured one person in September, the city asked the state to prohibit trucks on other parts of the highway, post warning signs about the steep grades of the road, and install an escape lane uphill from the dangerous intersection.

California Nursing Home Staff Lethally Drugged Patients

The decision to place a loved one in a nursing home can be difficult, especially when too many of these facilities are guilty of nursing home abuse.

Three Alzheimer's sufferers in California are believed to have died after nursing home staff members injected them with psychotropic drugs to keep them quiet. California Attorney General Edmund Brown revealed the deaths after announcing the arrests of a nurse, physician and pharmacist in Lake Isabella, just north of Los Angeles.

"These people maliciously violated the trust of their patients, by holding them down and forcibly administering psychotropic medications if they dared to question their care," Brown said in a statement.

Among those arrested is Gwen Hughes, director of nursing at the facility. Justice officials said that shortly after taking over in September 2006, Hughes ordered that dementia patients be given high doses of psychotropic medications to make them easier to “control”.

It was also stated that patients who argued with her were held down and forcibly given the injections. In addition to the three tragic deaths, several patients were alleged to have suffered medical complications from the injections.

The arrested workers face charges ranging from elder abuse to assault with a deadly weapon and face up to 11 years in prison if convicted.

Malpractice Settlement of $1.6 Million Leads L.A. Hospitals to Modify Consent Forms

When a hospital or doctor loses a medical malpractice case they may also lose a great deal of money and face a decline in their reputation.

One lawsuit in Los Angeles was so substantial that Los Angeles County hospitals are now seeking a way to standardize the patient consent form. This revamping is in response to a malpractice suit that cost the county $1.6 million to settle.

Shanay Bridges filed a lawsuit after a 2005 back surgery left her paralyzed. She asserted that no one fully explained the risks of the surgery to her. The county Board of Supervisors approved a settlement, but continued to say that her medical care was correct.

California is now looking into software that would keep electronic records of signed consent forms. The new standardized consent form is expected to be in use by the end of 2009.
