Portsmouth Emergency Room Error Resulted in the Death of an Infant
A Virginia mother brought her infant into the emergency room because the infant was lethargic, not eating, having bowel movement problems, and continuously vomiting a green substance.
The Emergency Room doctor did an ultrasound of the infant's stomach and an x-ray of her chest. Without finding the cause of the symptoms and without doing any other tests or exams, the doctor sent the mother and child home. This doctor failed to diagnose a bowel obstruction that resulted in the wrongful death of the infant.

Virginia Beach Landowner Faces Steep Wetlands Fines
Cody Bedford was told many times over a period of four years to cease and desist development on the property. He also failed to appear at several court dates to defend himself against charges. During this time, the Army Corps of Engineers and the US Environmental Protection Agency obtained soil samples and took aerial photos that showed changes to the property and the presence of fill material as much as two feet deep. In addition, three companies stated that they had delivered sand, dirt and fill to Bedford’s property—as much as 83 truckloads, or several hundred tons.
Bedford continues to claim that the previous owner filled in the 1.2 acres in question. A magistrate judge has found Bedford in clear violation of the Clean Water Act, and states that the $90,000 fine is conservative. Following stricter guidelines, the fine could have amounted to as much as $53 million.

Portsmouth Mayor’s Wife Files Lawsuit
Mary Holley was seriously injured in June, 2007 after Aston backed into her while she was walking across the parking lot of the bank. The lawsuit seeks $3 million in damages.
Holley’s attorney says until this point he has only dealt with insurance carriers, including Aston’s insurance company and the carrier for the bank. But, he continues, offers made by the carriers were insufficient given the extent of Holley’s injuries. Holley, 76, was treated in intensive care for over a week. Her attorney states her medical bills are in excess of $100,000.
Because the accident occurred on bank premises, and because Aston was performing in his position as CEO at the time, the lawsuit was filed against both Aston and the bank.
