Traumatic Brain Injury in San Francisco/Oakland, California

Fatal Rollover Accident Caused by Refrigerator in Road

Late on May 11, on a busy city highway, a Chevrolet Tracker carrying three people on the highway swerved to avoid a refrigerator in the middle of the road. The truck did not turn around the obstacle. Instead, the vehicle tipped over and rolled, ejecting all three passengers, one of whom were killed, and two of whom were taken to a local hospital with serious injuries. Although many people contributed to this tragic car accident-the person who left the debris on the road, people who did not report the debris soon enough to have it removed, the driver who may have swerved drastically, even the passengers who were not wearing their seat belts-only one of them did so as a calm, deliberative action with a profit motive: the manufacturer of the light SUV, which had a tendency to tip.

The Chevrolet Tracker is a light SUV, and it receives marginal marks for rollover safety. According to NHTSA testing, the vehicle had a significant likelihood of tipping over during highway maneuvers. SUVs were a profitable market for many carmakers, and many were designed on truck bodies, often without considering how redistributing the weight of the vehicle would affect its stability. This led to the design and production of numerous defective and dangerous vehicles.

Tainted Water Bottles Sicken Kids at California Middle School

Twelve middle school aged children have been hospitalized after drinking water from bottles they got from a vending machine in Santa Clarita, California. Fire officials received reports that people were becoming ill at the school on Thursday afternoon. The children who became sick complained of cramps and headaches, and all were transported to nearby medical clinics. Along with local authorities, the FBI is investigating.

Though it isn't clear what was in the water to make those who drank it sick, it was cloudy and had a strange smell and could have been related to bleach, according to a county fire inspector. How it got in there is anyone's guess. The bottles do not appear to be tampered with, which indicates there could be a problem at the bottling plant.

However, the Pepsi Bottling Group, which owns Aquafina and the bottling plant, released a statement claiming there is no evidence that anything in their manufacturing process caused the illnesses. They examined and tasted other bottles that were produced at the same time, and conducted their own tests. The corporation believes this is an "isolated incident."

Until more tests are completed, there is no way of knowing what may have been in the bottles. One doctor has said this could possibly be a psychosomatic reaction of one child drinking water and becoming sick, and others who drank the water imagined they had the same symptoms. All children may imagine things, and some may overreact, but it is in the best interest of all to get to the bottom of this. If it turns out the water had some kind of toxin in it, the fact only 12 children were sickened may be a blessing.

Truck Accident in California Kills 2 and Injures 12

A truck transporting cars lost control coming off a highway and crashed into a bookstore in La Canada Flintridge, California. The truck careened through an intersection during rush hour, smashing several vehicles before coming to rest in the bookstore. A man and his 12-year-old daughter were killed when the truck ran over the car they were in, and twelve others were injured. Three people remain in critical condition. Besides the damage done to the bookstore, a wine store and nail salon were also damaged.

The highway the truck accident occurred on runs through the town near Los Angeles. Authorities have said the truck lost control as it was coming off the highway and could not make a turn. City officials in La Canada Flintridge have complained to CalTrans about the dangers of the intersection. After a collision involving a semi-truck that injured one person in September, the city asked the state to prohibit trucks on other parts of the highway, post warning signs about the steep grades of the road, and install an escape lane uphill from the dangerous intersection.

Allegations of Bullying Lead to Lawsuit

Twice in three days a teenager was assaulted at the A.P. Giannini Middle School by bullies who used an umbrella handle in an attempt to “sodomize” him. A lawsuit was filed against the two alleged bullies, the Aspiranet nonprofit agency and the San Francisco Unified School District, claiming negligence in supervision, sexual assault, battery and infliction of emotional distress. Aspiranet operates the Sunset Neighborhood Beacon Center in collaboration with San Francisco Unified School District providing after school programs for the A.P. Giannini Middle School students.

Bullying is a growing problem in schools and places where youth go for recreation. All students are required to attend school, and therefore should expect to be assured of safety while in the care of school employees and agents. Wrongful Death in NY Subway Accident

In 2006 an intoxicated Dustin Dibble stumbled onto subway tracks, falling into the path of a Manhattan subway. The subway driver failed to stop, severing Dibble’s right leg as the subway ran over him.

Dibble was awarded just under $3.6 million in a jury decision this week. However, since the jury also found that despite his intoxication, Dibble was only 35% responsible for the accident, they reduced the settlement to 65% of the award.

The subway driver neglected to even try to stop because he said he thought that Dibble was just garbage on the tracks and not a person. Dibble’s attorney stressed that the NYC Transit was more responsible for the accident than his client because the subway driver did have time to stop. Apparently, the jury agreed.

Subway drivers are trained to look for people on the tracks and are aware that people are often intoxicated at nighttime.
