{"id":1032,"date":"2022-02-23T16:04:41","date_gmt":"2022-02-23T16:04:41","guid":{"rendered":"https:\/\/www.cochranfirm.com\/memphis\/use-of-excessive-force-should-the-public-see-records-from-mpd\/"},"modified":"2023-04-24T12:42:21","modified_gmt":"2023-04-24T12:42:21","slug":"use-of-excessive-force-should-the-public-see-records-from-mpd","status":"publish","type":"post","link":"https:\/\/www.cochranfirm.com\/memphis\/use-of-excessive-force-should-the-public-see-records-from-mpd\/","title":{"rendered":"Use of Excessive Force, Should the Public See Records from MPD?"},"content":{"rendered":"<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>As advocates call for transparency, the question gets raised on whether or not the Use of Excessive Force should be public records.<\/p>\n<p>FOX13 investigated allegations of <a href=\"https:\/\/www.commercialappeal.com\/story\/news\/2019\/02\/26\/civilian-law-enforcement-review-board-memphis-police-trent-collier\/2864904002\/\" target=\"_blank\" rel=\"noopener noreferrer\">excessive force by Memphis Police Officers.<\/a> Your ability to know how many cases exist and what happened to the officers investigated for possible wrongdoing.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>We discovered that kind of data is only available through Memphis Police and is not easily accessible to you, the public.<\/p>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"continue_below\" class=\"card-content card-article\">\n<p>Advocates for policy transparency said that it is unacceptable.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>Three recent cases of allegations of excessive force by MPD officers put the spotlight on the department and its use of force policy.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>On the first night of protests against <a href=\"https:\/\/www.nytimes.com\/2020\/05\/31\/us\/george-floyd-investigation.html\" target=\"_blank\" rel=\"noopener noreferrer\">the killing of George Floyd by a Minneapolis Police officer<\/a>, a Memphis Police Officer is caught on cell phone camera knocking a protester to the ground with his riot shield.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>The woman appeared to be unaware the officer was going to use force.<\/p>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>During the same night, a Memphis Police officer pointed an SLG rifle, at a FOX13 News crew as they walked backward covering the demonstrations. According to the department\u2019s public information officer, is used to fire rubber bullets.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>While all three cases are currently under investigation by Memphis Police, The <a href=\"https:\/\/cochranfirmmidsouth.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Cochran Law Firm of the Mid-South<\/a>\u00a0managing partner <a href=\"https:\/\/cochranfirmmidsouth.com\/about\/howard-manis\/\" target=\"_blank\" rel=\"noopener noreferrer\">Howard Manis<\/a> called them troubling.<\/p>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>\u201cI think there is some significant overreacting and over-policing going on, which, whether intended or not, is to intimidate,\u201d Manis said.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>At a June 1 news conference, Memphis Police Director Mike Rallings told FOX 13 those three cases don\u2019t accurately portray Memphis Police Department\u2019s interaction with the public.<\/p>\n<\/div>\n<\/div>\n<div class=\"card collection-item \" data-type=\"text\">\n<div id=\"\" class=\"card-content card-article\">\n<p>\u201cEach year this police department makes over 60,000 arrests,\u201d Rallings said. \u201cWith those arrests, officers use force only two percent of the time.\u201d The lack of accessible data on excessive force is not just a Memphis problem, but a national one.
