{"id":2424,"date":"2021-08-31T13:57:35","date_gmt":"2021-08-31T13:57:35","guid":{"rendered":"https:\/\/www.cochranfirm.com\/new-orleans\/?post_type=sub-practice-areas&#038;p=2424"},"modified":"2021-12-10T16:42:05","modified_gmt":"2021-12-10T16:42:05","slug":"large-truck-regulation","status":"publish","type":"sub-practice-areas","link":"https:\/\/www.cochranfirm.com\/new-orleans\/large-truck-regulation\/","title":{"rendered":"Are Large Trucks Regulated by the Federal Government"},"content":{"rendered":"\n<p>Yes, The Federal Motor Carrier Safety Administration (FMCSA) issues regulations which govern the safety and oversight of commercial motor vehicles.&nbsp; Its mission is to reduce crashes, injuries and fatalities involving large trucks and buses.&nbsp; The FMCSA was established as a separate administration within the U.S. Department of Transportation on January 1, 2000, pursuant to the Motor Carrier Safety and Improvement Act of 1999.&nbsp; It is headquartered in Washington D.C. and employs more than 1,000 people in all 50 states.<\/p>\n\n\n\n<p>Some of the rules issued by the FMCSA regulate the hours that commercial truck drivers can operate their vehicles in a 24-hour period.&nbsp; These rules were designed to increase safety and decrease accidents related to truck driver fatigue.&nbsp; Other rules govern the inspection, repair and maintenance of commercial vehicles and the transportation and parking rules for hazardous materials.<\/p>\n\n\n\n<p>The FMCSA also regulates the driving credentials of commercial motor carriers to help ensure that the safest and most qualified drivers are operating large trucks.&nbsp; The rules apply to every person who operates a commercial motor vehicle in interstate, foreign, or intrastate commerce, to all employers of such persons, and to all States.&nbsp; Some of these regulations include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Prohibiting a commercial driver from having more than one driver\u2019s license;<\/li><li>Requiring a driver to notify his\/her employer of a conviction for violating a state or local traffic law in any type of vehicle;<\/li><li>Requiring that a driver provide previous employment information when applying for employment as an operator of a commercial motor vehicle;<\/li><li>Establishing periods of disqualification and penalties for those persons convicted of certain criminal and other offenses;<\/li><li>Prohibiting an employer from allowing a person with a suspended license to operate a commercial vehicle;<\/li><li>Establishing testing and licensing requirements for commercial motor vehicle operators;<\/li><li>Requires States to give knowledge and skills tests to all qualified applicants for commercial drivers\u2019 licenses;<\/li><li>Establishing requirements for the State issued commercial license documentation.<\/li><\/ul>\n\n\n\n<p>&nbsp;There are exceptions for certain military drivers and for farmers, firefighters and emergency response vehicle drivers and drivers removing snow and ice.<\/p>\n","protected":false},"featured_media":2426,"template":"","meta":{"_acf_changed":false,"_seopress_robots_primary_cat":"","_seopress_titles_title":"","_seopress_titles_desc":"","_seopress_robots_index":""},"categories":[102],"class_list":["post-2424","sub-practice-areas","type-sub-practice-areas","status-publish","has-post-thumbnail","hentry","category-trucking"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/sub-practice-areas\/2424","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/sub-practice-areas"}],"about":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/types\/sub-practice-areas"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/media\/2426"}],"wp:attachment":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/media?parent=2424"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/categories?post=2424"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
