{"id":2431,"date":"2021-08-31T14:08:21","date_gmt":"2021-08-31T14:08:21","guid":{"rendered":"https:\/\/www.cochranfirm.com\/new-orleans\/?post_type=sub-practice-areas&#038;p=2431"},"modified":"2021-11-08T21:28:50","modified_gmt":"2021-11-08T21:28:50","slug":"drivers-hours","status":"publish","type":"sub-practice-areas","link":"https:\/\/www.cochranfirm.com\/new-orleans\/drivers-hours\/","title":{"rendered":"Are Drivers Hours of Operation Regulated?"},"content":{"rendered":"\n<p>The Federal Motor Carrier Safety Administration (FMCSA) specifically regulates how many hours a commercial truck driver can drive during a 24-hour period.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>At the start of a work shift a driver may not drive without first taking 10 consecutive hours off duty.<\/li><li>A driver may not drive after a period of 14 consecutive hours after coming on duty following 10 consecutive hours off duty<\/li><li>A driver may only drive a total of 11 hours of the 14 hours allowed in the section above<\/li><li>Driving is not permitted if more than 8 hours of driving time have passed without at least a consecutive 30-minute interruption in driving status.<\/li><li>If the employer operates commercial vehicles 7 days a week, a driver may not be on duty for more than 70 hours in any period of 8 consecutive days.<\/li><li>Any period of 7 consecutive days may end with the beginning of an off duty period of 34 or more consecutive hours.<\/li><\/ul>\n\n\n\n<p>There are a couple of exceptions that generally apply to these restrictions.&nbsp; First if a driver encounters an adverse driving condition which does not allow him\/her to safely complete the run within the maximum driving time he may be permitted to drive for an additional two hours beyond the maximum allowable hours.&nbsp;<\/p>\n\n\n\n<p>Adverse driving condition means snow, ice, sleet, fog or other adverse weather conditions or unusual road or traffic conditions that were not known, or could not reasonably be known, to a driver immediately prior to the beginning of the duty.<\/p>\n\n\n\n<p>Also, in case of any emergency, a driver may complete his\/her run without being in violation of the hours limitation if such run reasonably could have been completed absent the emergency.<\/p>\n","protected":false},"featured_media":2433,"template":"","meta":{"_acf_changed":false,"_seopress_robots_primary_cat":"","_seopress_titles_title":"","_seopress_titles_desc":"","_seopress_robots_index":"","_seopress_analysis_target_kw":""},"categories":[103],"class_list":["post-2431","sub-practice-areas","type-sub-practice-areas","status-publish","has-post-thumbnail","hentry","category-are-large-trucks-regulated"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/sub-practice-areas\/2431","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/sub-practice-areas"}],"about":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/types\/sub-practice-areas"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/media\/2433"}],"wp:attachment":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/media?parent=2431"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/categories?post=2431"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
