{"id":2437,"date":"2021-08-31T14:11:50","date_gmt":"2021-08-31T14:11:50","guid":{"rendered":"https:\/\/www.cochranfirm.com\/new-orleans\/?post_type=sub-practice-areas&#038;p=2437"},"modified":"2021-08-31T14:13:24","modified_gmt":"2021-08-31T14:13:24","slug":"truck-insurance","status":"publish","type":"sub-practice-areas","link":"https:\/\/www.cochranfirm.com\/new-orleans\/truck-insurance\/","title":{"rendered":"Truck Insurance Regulations"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Most States have insurance laws that require certain levels of insurance coverage for passenger vehicles (cars).&nbsp; These laws, however, typically do not apply to large trucks.&nbsp; Some States have enacted minimum levels of insurance that trucks with certain gross weights must carry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Federal Motor Carrier Safety Administration has issued regulations specific to large trucks&nbsp; that require them to carry certain levels of insurance coverage. Section 387 of the FMCS Regulations governs these mandatory insurance requirements.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;Section 387.1 states:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>This subpart prescribes the minimum levels of financial responsibility required to be maintained by motor carriers of property operating motor vehicles in interstate, foreign or intrastate commerce.&nbsp; The purpose of these regulations is to create additional incentives to motor carriers to maintain and operate their vehicles in a safe manner and to assure that motor carriers maintain an appropriate level of financial responsibility for motor vehicles operated on public highways.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 387.7 states in part:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>(a)<\/em>&nbsp; &nbsp; <em>No motor carrier shall operate a motor vehicle until the motor carrier has obtained and has in effect the minimum levels of financial responsibility as set forth in Section 387.9 of this subpart.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 387.9 provides that \u201cFor-hire, in interstate or foreign commerce, with a gross vehicle weight rating of 10,001 or more pounds, for non-hazardous property the carrier must maintain insurance coverage of <strong>at least $750,000<\/strong>.&nbsp; If the For-hire and private carrier is carrying hazardous substances, the minimum level of insurance is <strong>$5,000,000.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exception to this rule is for motor vehicles that have a gross weight of less than 10,001 pounds.&nbsp; However, the exception does not apply if the vehicle is used to transport hazardous substances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the FMCSA regulation requires at least $750,000 in insurance coverage, many trucking companies carry much more in insurance coverage, especially if the company utilizes a fleet of trucks for its operations.&nbsp; Policies with coverage as high as $100,000,000 are not uncommon with large carriers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These higher coverages are a direct recognition of the massive damage large trucks can cause when they are involved in accidents, especially with smaller passenger vehicles.<\/p>\n","protected":false},"featured_media":2439,"template":"","meta":{"_acf_changed":false,"_seopress_titles_title":"","_seopress_titles_desc":"","_seopress_robots_index":"","_seopress_robots_follow":"","_seopress_robots_imageindex":"","_seopress_robots_snippet":"","_seopress_robots_primary_cat":"","_seopress_robots_breadcrumbs":"","_seopress_robots_freeze_modified_date":"","_seopress_robots_custom_modified_date":"","_seopress_robots_canonical":"","_seopress_social_fb_title":"","_seopress_social_fb_desc":"","_seopress_social_fb_img":"","_seopress_social_fb_img_attachment_id":0,"_seopress_social_fb_img_width":0,"_seopress_social_fb_img_height":0,"_seopress_social_twitter_title":"","_seopress_social_twitter_desc":"","_seopress_social_twitter_img":"","_seopress_social_twitter_img_attachment_id":0,"_seopress_social_twitter_img_width":0,"_seopress_social_twitter_img_height":0,"_seopress_redirections_value":"","_seopress_redirections_enabled":"","_seopress_redirections_enabled_regex":"","_seopress_redirections_logged_status":"","_seopress_redirections_param":"","_seopress_redirections_type":301,"_seopress_analysis_target_kw":"","_seopress_news_disabled":"","_seopress_video_disabled":"","_seopress_video":[],"_seopress_pro_schemas_manual":[{"_seopress_pro_rich_snippets_type":"none"}],"_seopress_pro_rich_snippets_disable_all":"","_seopress_pro_rich_snippets_disable":[],"_seopress_pro_schemas":[]},"categories":[103],"class_list":["post-2437","sub-practice-areas","type-sub-practice-areas","status-publish","has-post-thumbnail","hentry","category-are-large-trucks-regulated"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/sub-practice-areas\/2437","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/sub-practice-areas"}],"about":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/types\/sub-practice-areas"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/media\/2439"}],"wp:attachment":[{"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/media?parent=2437"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/new-orleans\/wp-json\/wp\/v2\/categories?post=2437"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
