The mediator has no authority to impose a decision, so\nnothing is decided unless both parties agree on it. This form of resolution can\nbe used in most non-criminal cases and is proven to be effective with mutual\nsatisfaction. Before deciding whether mediation is right for you, it\u2019s\nimportant to understand the stages that take place and how to make it work. <\/p>\n\n<h2>\n\tStages Of Mediation\n<\/h2>\n\n\n<h3 class=\"wp-block-heading\">Stage 1: Mediator\u2019s Opening Statement<\/h3>\n\n\n\n<p>The mediator will start the conversation by introducing\neveryone, explaining the goals and rules of the mediation, and encouraging both\nparties to work cooperatively.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stage 2: Disputants\u2019 Opening Statement<\/h3>\n\n\n\n<p>Each party has the opportunity to tell their side of the\nstory, one at a time. They will most likely describe what the dispute is about\nand how he or she has been affected by it. They may then also present some\ngeneral ideas on how to resolve the problem. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stage 3: Joint Discussion<\/h3>\n\n\n\n<p>At this point, it is time for both parties to determine\nwhich issues need to be addressed. The mediator may ask questions to get the\nparties talking and move the conversation forward.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stage 4: Private Caucuses<\/h3>\n\n\n\n<p>A private caucus is a chance for each party to meet privately with the mediator, offering a pathway to ways to <a href=\"https:\/\/cochranfirmphiladelphia.com\/ways-to-keep-disputes-out-of-court\/\">keep disputes out of court<\/a>. This may occur just once with each side or several\ntimes. The mediator and each party can discuss strengths and weaknesses of\ntheir position and new ideas to reach a settlement. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stage 5: Joint Negotiation<\/h3>\n\n\n\n<p>After the private caucuses, the mediator will bring the\nparties back together to negotiate face to face.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Stage 6: Closure<\/h3>\n\n\n\n<p>If an agreement has been reached, the mediator will put the\nmain provisions in writing and may ask each side to sign the written summary of\nagreement. If no agreement has been reached, the mediator will advise the\nparties of their options, such as another meeting or <a href=\"https:\/\/cochranfirmphiladelphia.com\/terms-you-will-need-to-know-on-your-day-in-court\/\">going to court<\/a>. The\nwritten summary of agreement may also be taken to a lawyer for review. <\/p>\n\n\n\n<p>In mediation, the goal is not to win. The goal is resolution. It is important to be respectful, cooperative, and willing to compromise.
