{"id":1129,"date":"2015-06-11T14:59:38","date_gmt":"2015-06-11T14:59:38","guid":{"rendered":"https:\/\/www.cochranfirm.com\/washington-dc\/d-c-public-schools-largest-food-vendor-settles-whistleblower-lawsuit-for-19-4-million\/"},"modified":"2024-03-07T09:27:49","modified_gmt":"2024-03-07T15:27:49","slug":"d-c-public-schools-largest-food-vendor-settles-whistleblower-lawsuit-for-19-4-million","status":"publish","type":"post","link":"https:\/\/www.cochranfirm.com\/washington-dc\/d-c-public-schools-largest-food-vendor-settles-whistleblower-lawsuit-for-19-4-million\/","title":{"rendered":"DC Public Schools' largest food vendor settles whistleblower lawsuit for $19.4 million"},"content":{"rendered":"<p><a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/wp-content\/uploads\/2015\/06\/Chartwells-Logo-hi-res.jpg\"><img decoding=\"async\" class=\"alignleft size-medium wp-image-3597\" src=\"https:\/\/www.cochranfirm.com\/washington-dc\/wp-content\/uploads\/2015\/06\/Chartwells-Logo-hi-res-300x185.jpg\" alt=\"Chartwells Logo hi res\" width=\"300\" height=\"185\" \/><\/a>Chartwells, the largest food vendor for DC Public Schools (DCPS), recently agreed to a <strong>$19.4 million<\/strong> settlement with the the District of Columbia\u2019s Office of the Attorney General to resolve claims the vendor overcharged the city\u2019s government and provided substandard nutrition to students. \u00a0Terms of the settlement include over $14 million in repayment to the District government and another $5 million in philanthropic payments to DC schools and nonprofit organizations. \u00a0DCPS will continue its contract with Chartwells.<\/p>\n<p>The settlement comes as a result of a <a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/whistleblower-lawyer-qui-tam-claims\/\">whistleblower action<\/a> initiated by Jeffrey Mills, a\u00a0former executive director of the school system\u2019s Office of Food and Nutritional Services. \u00a0Mills was fired from his position in 2013 and has since recovered $450,000 in his own separate settlement with the District alleging wrongful termination. \u00a0Mill\u2019s wrongful termination suit alleged he was fired for raising concerns over Chartwells mismanagement of the contract with DCPS.<\/p>\n<p>The contract between Chartwells and DCPS was supposed to be a cost saving and quality control measure by shifting food preparation for DCPS from in-house operations to private contractors. \u00a0The goal was to reduce costs and provide more nutritious meals of DCPS students. \u00a0Instead, Mill\u2019s suit alleges, the contract was wrought with mismanagement including overcharging for services, delivering rotting food, and an inability to fulfill orders.<\/p>\n<p>Chartwells and its parent company, Compass Group USA, are no strangers to controversy. \u00a0In 2014, students at a Connecticut high school staged a boycott of Chartwells\u2019 school lunches and in 2012 Compass Group USA settled its own $18 million lawsuit brought by the New York state Attorney General.<\/p>\n<p>Mills brought his suit under the <a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/whistleblower-lawyer-qui-tam-claims\/qui-tam-whistleblower-lawsuit\/\"><i>qui tam<\/i><\/a> provisions of the <a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/whistleblower-lawyer-qui-tam-claims\/false-claims-act\/\">False Claims Act<\/a>. \u00a0<i>Qui tam<\/i> actions allow private citizens to bring civil lawsuits on behalf of the government to recover money lost through fraud, waste, or abuse of government contracts. \u00a0While The Cochran Firm, DC did not represent Mr. Mills in this case, The Cochran Firm, DC handles <i>qui tam<\/i>\u00a0litigation and other whistleblower complaints.
