{"id":1131,"date":"2015-06-16T18:59:06","date_gmt":"2015-06-16T18:59:06","guid":{"rendered":"https:\/\/www.cochranfirm.com\/washington-dc\/trinity-guardrails-whistleblower-awarded-199-million\/"},"modified":"2022-05-05T14:07:24","modified_gmt":"2022-05-05T14:07:24","slug":"trinity-guardrails-whistleblower-awarded-199-million","status":"publish","type":"post","link":"https:\/\/www.cochranfirm.com\/washington-dc\/trinity-guardrails-whistleblower-awarded-199-million\/","title":{"rendered":"Trinity Guardrails whistleblower awarded $199 million"},"content":{"rendered":"<h3><em><b>Federal Judge more than triples jury verdict<\/b><\/em><\/h3>\n<p><a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/wp-content\/uploads\/2014\/10\/guardrail-accident-lawyer.jpg\"><img decoding=\"async\" class=\" size-medium wp-image-2665 alignleft\" src=\"https:\/\/www.cochranfirm.com\/washington-dc\/wp-content\/uploads\/2014\/10\/guardrail-accident-lawyer-300x174.jpg\" alt=\"guardrail-accident-lawyer\" width=\"300\" height=\"174\"><\/a>Joshua Harman, the Virginia man at the center of a $663 million settlement with Trinity Industries, is walking away with $199 million after filing a&nbsp;<a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/whistleblower-lawyer-qui-tam-claims\/qui-tam-whistleblower-lawsuit\/\"><i>qui tam<\/i> lawsuit<\/a>. &nbsp;The award comes after a federal court&nbsp;in Texas more than tripled a $175 million verdict handed down by a jury last year and tacked on an additional civil penalty of $138 million. &nbsp;Mr. Harman was awarded 30% of the settlement, the most allowed for whistleblowers under the federal&nbsp;<a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/whistleblower-lawyer-qui-tam-claims\/false-claims-act\/\">False Claims Act<\/a>.<\/p>\n<p>In 2012, Mr. Harman filed a whistleblower&nbsp;lawsuit against Trinity Industries on behalf of the federal government. &nbsp;His suit alleged Trinity Industries made modifications to its <a href=\"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/defective-product-attorneys\/trinity-guardrail-injury-lawsuit\/\">ET-Plus guardrail system<\/a> without having the changes approved by federal safety regulators. &nbsp;The ET-Plus guardrails are the end terminals of guardrails along highways. &nbsp;The end terminals are supposed&nbsp;to \"ribbon off\" if struck head-on by a vehicle, reducing the damage and risk of serious injury or death to the driver.
