Haynes and Associate Attorney Samantha L. Peters recently secured a $3.636 million verdict on behalf of a Baltimore man who suffered catastrophic injuries due to a doctor’s negligence.

“We are very pleased with the jury’s result,” said Mr. Haynes. “What happened to our client was unacceptable and this case demonstrates the lengths to which The Cochran Firm, DC and its attorneys will go to secure the compensation our clients need to be made whole again.”

Jurors heard 6 days of testimony before deliberating on the case, ultimately agreeing with the plaintiff that the defendant was negligent in his care of the victim. The jury’s award consisted of past medical bills, future medical care, and compensation for the pain and suffering of living through the injury.

“The Cochran Firm, DC is glad to be on the right side of cases like these,” Ms. Peters said. “Patients have the right to competent and effective medical treatment and when doctors violate the standards of care, our legal system gives victims the right to seek justice in a court of law.”

Routine procedure results in life changing injuries to victim

In May 2015, the plaintiff presented to the emergency room at Bon Secours Hospital with complaints suggestive of a small bowel obstruction. The victim, a paraplegic since approximately 1990, was admitted to Bon Secours Hospital and a diagnosis of small bowel obstruction was confirmed on imaging.

Approximately 35-hours after admittance, the defendant-surgeon assigned to the plaintiff came in to meet the patient for the first time. The defendant decided to pursue conservative treatment and inserted a nasogastric tube (NG tube) to decompress the victim’s stomach. Unsure of whether the NG tube would successfully relieve the obstruction, the defendant scheduled the plaintiff for surgery the following morning.

Sometime in the early morning hours before the surgery, the plaintiff’s NG tube came out and the victim vomited through the night and into the following day. The defendant failed to reinsert the NG tube prior to the plaintiff being taken into the operating room, despite the patient’s active vomiting and diagnosis of small bowel obstruction, which greatly increased the chance the victim would suffer an aspiration event.

As the induction of anesthesia began and the anesthesiologist was about to intubate the plaintiff, the victim vomited and aspirated the vomit into his lungs. As a result, the plaintiff suffered from aspiration pneumonia, Acute Respiratory Distress Syndrome (ARDS), sepsis, and other complications, leading to severe and permanent injury.

Medical Malpractice Lawyers serving Baltimore, Maryland, and Washington, DC

If you or a loved one were injured because of a doctor’s mistake, you could be entitled to substantial compensation.
