{"id":1574,"date":"2016-07-11T20:36:17","date_gmt":"2016-07-11T20:36:17","guid":{"rendered":"https:\/\/www.cochranfirm.com\/washington-dc\/?post_type=practice_areas&#038;p=1574"},"modified":"2022-12-19T12:16:31","modified_gmt":"2022-12-19T18:16:31","slug":"false-claims-act","status":"publish","type":"practice_areas","link":"https:\/\/www.cochranfirm.com\/washington-dc\/practice-areas\/whistleblower-lawyer-qui-tam-claims\/false-claims-act\/","title":{"rendered":"False Claims Act Whistleblower Lawsuit"},"content":{"rendered":"<h3><b>Qui tam and False Claims Act cases<\/b><\/h3>\n<p>The False Claims Act, also known as the Lincoln Law, is the principal tool for prosecuting fraudulent billing cases perpetrated against the federal government. &nbsp;It was enacted in 1863 during the Civil War to prevent contractors from defrauding the Union Army. &nbsp;The False Claims Act imposes liability on private companies, contractors, or individuals who knowingly defraud the government or conspire to do so. &nbsp;The law has been amended three times since 1986.<\/p>\n<p>An important provision of the False Claims Act is known as<i>qui tam<\/i>. &nbsp;<i>Qui tam<\/i> cases are civil actions initiated by private citizens on behalf of the federal government. &nbsp;Individuals who file <i>qui tam<\/i> complaints are known as \u201crelators\u201d and may recover between 15% and 30% of damages awarded to the government. &nbsp;Since 1987, 70% of all damages recovered under the the False Claims Act were initiated by<i>qui tam<\/i> cases, amounting to <strong>$27 billion<\/strong>.<\/p>\n<p>Relators are entitled to protection against retaliation by his or her employer when reporting acts of fraud as a whistleblower. The False Claims Act holds that retaliating&nbsp;employers&nbsp;may have to pay&nbsp;attorney\u2019s fees and double the amount of damages for their wrongful acts. &nbsp;Relators are placed&nbsp;under employment protection if they bring a <i>qui tam<\/i> case and may receive double back pay and special damages if terminated after&nbsp;filing a whistleblower claim.<\/p>\n<h3><b>The False Claims Act prohibits:<\/b><\/h3>\n<ul>\n<li>Presenting the government a false claim for payment or approval<\/li>\n<li>Making a false statement on a fraudulent claim<\/li>\n<li>Conspiracy to violate the False Claims Act<\/li>\n<li>Delivering less than all money or property owed to the government<\/li>\n<li>Authorizing false receipts for payments<\/li>\n<li>Buying government property from an entity or person unauthorized to do so<\/li>\n<li>Falsifying records to decrease or avoid payments to the government<\/li>\n<\/ul>\n<h3><b>Applications of the False Claims Act<\/b><\/h3>\n<p>Lawsuits brought under the False Claims Act are&nbsp;filed under seal in federal court. &nbsp;The Department of Justice (DOJ) will then investigate the case and decide whether to pursue the case (known as \u201cintervention\u201d or \u201cintervening\u201d). Typically, cases pursued by the DOJ have a much higher success rate of recovering damages but less than 25% of filed&nbsp;<i>qui tam<\/i> cases receive DOJ&nbsp;intervention.<\/p>\n<p>Thirty states and the District of Columbia have their own False Claims Act laws. &nbsp;They provide similar <i>qui tam<\/i>provisions for relators to recover damages against the state for fraud perpetrated against publicly-funded programs.<\/p>\n","protected":false},"featured_media":0,"parent":1633,"menu_order":55,"template":"","meta":{"_acf_changed":false,"_seopress_robots_primary_cat":"","_seopress_titles_title":"","_seopress_titles_desc":"","_seopress_robots_index":"","_seopress_analysis_target_kw":""},"categories":[],"is_parent":[],"class_list":["post-1574","practice_areas","type-practice_areas","status-publish","hentry"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/practice_areas\/1574","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/practice_areas"}],"about":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/types\/practice_areas"}],"up":[{"embeddable":true,"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/practice_areas\/1633"}],"wp:attachment":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/media?parent=1574"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/categories?post=1574"},{"taxonomy":"is_parent","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/is_parent?post=1574"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
