Although nothing can take back the harm done, the laws gives injury victims the legal right to recover compensation from those who caused the accident.<\/p>\n<h4><b>DC statute on damages for emotional distress<\/b><\/h4>\n<p><i>Restatement (Third) of Torts, sec. 46<\/i>:<\/p>\n<p><em>\u00a7 46 Negligent Conduct Directly Inflicting Emotional Disturbance on Another<\/em><\/p>\n<p>An actor whose negligent conduct causes serious emotional<\/p>\n<p>disturbance to another is subject to liability to the other if the<\/p>\n<p>conduct:<\/p>\n<p style=\"text-align: left;\">(a) places the other in immediate danger of bodily harm and the<\/p>\n<p style=\"text-align: left;\">emotional disturbance results from the danger; or<\/p>\n<p style=\"text-align: left;\">(b) occurs in the course of specified categories of activities,<\/p>\n<p style=\"text-align: left;\">undertakings, or relationships in which negligent conduct is<\/p>\n<p style=\"text-align: left;\">especially likely to cause serious emotional disturbance.<\/p>\n<p>DC injury laws allow victims to recover compensation for both pecuniary damages (monetary) and non-monetary damages for pain and suffering, including emotional distress. Washington, DC courts have outlined several types of cases where victims can recover damages for emotional distress, including:<\/p>\n<ul>\n<li><a href=\"\/washington-dc\/laws-litigation\/pain-and-suffering\/\">Pain and suffering<\/a> directly resulting from a personal injury, such as an auto crash or medical malpractice event<\/li>\n<li>Negligent conduct likely to cause emotional distress where defendants have a legal duty to care for the wellbeing of the victim, such as a doctor delivering positive diagnosis which turns out to be false<\/li>\n<li>Spouses filing suit against negligent parties for the loss of consortium (emotional enjoyment), husbands and wives suing the defendant for the loss of time spent with their spouse<\/li>\n<li>Emotional distress from being placed in the \u201czone of danger,\u201d being near a dangerous accident where the plaintiff believed he or she would suffer a serious injury<\/li>\n<li>Intentional infliction of emotional distress in \u201cextreme and outrageous\u201d situations, repeated harassment, stalking, or death threats (see below for more details)<\/li>\n<\/ul>\n","protected":false},"featured_media":0,"parent":1769,"menu_order":18,"template":"","meta":{"_acf_changed":false,"_seopress_robots_primary_cat":"","_seopress_titles_title":"","_seopress_titles_desc":"","_seopress_robots_index":""},"categories":[],"is_parent":[],"class_list":["post-1610","practice_areas","type-practice_areas","status-publish","hentry"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/practice_areas\/1610","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/practice_areas"}],"about":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/types\/practice_areas"}],"up":[{"embeddable":true,"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/practice_areas\/1769"}],"wp:attachment":[{"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/media?parent=1610"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/categories?post=1610"},{"taxonomy":"is_parent","embeddable":true,"href":"https:\/\/www.cochranfirm.com\/washington-dc\/wp-json\/wp\/v2\/is_parent?post=1610"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
