Sunnyvale, Calif.-based Intuitive Surgical Inc. has manufactured the da Vinci robotic surgery system for more than 10 years. In July 2013, the U.S. Food and Drug Administration (FDA) issued a recall on several of Intuitive’s devices after the maker of da Vinci Surgical Systems robots admitted that 30 devices may not have been tested properly. The recall affected its da Vinci Si Vision System Cart, Si Surgeon Side Cart, Instrument Control Box, and Dual Camera Controller.
Intuitive Surgical designed the da Vinci Surgical Systems robot to allow surgeons to make small incisions with more precision. The robot has four remote-controlled arms and a three-dimensional camera that is designed to make certain types of surgery (gynecologic, laparoscopic, and urologic) less invasive and to speed up healing times.
In an Oct. 18, 2013 filing with the Securities and Exchange Commission, Intuitive Surgical stated that it is a defendant in 50 product liability lawsuits arising from injuries and deaths allegedly caused by the da Vinci Surgical System. The medical products company also said it had been named as a defendant in a class action lawsuit filed in Louisiana over the da Vinci surgical robot. The case raises several allegations, including that the da Vinci Surgical System’s defect caused patient injuries, that Intuitive Surgical filed to provide adequate training resources to healthcare professionals, and that the da Vinci Surgical Systems robot contains design defects.
Individuals who have been injured by the da Vinci Surgical Systems robot may be eligible for compensation, including for medical bills, pain and suffering, loss of companionship, lost past and future wages, and physical therapy.
