What is Social Security Disability?

Social Security Disability Insurance (SSD or SSDI) is a federal insurance program managed by the U.S. government and funded by payroll taxes paid by working Americans. Managed and implemented by the Social Security Administration, the program was created to provide supplemental income to Americans whose ability to work is restricted due to injury. Social Security Disability can be temporary or permanent based on whether the applicant’s disability is permanent or not. Social Security Disability is available to all disabled Americans regardless of their level of income. In order to receive SSD, the Social Security Administration (SSA) states a person must:

  • Have a physical or mental condition that prevents them from participating in “substantial gainful activity”, and
  • The condition is expected to last at last a year or result in death, and
  • They are under age 65, and
  • They have accumulated 20 social security credits in the last 10 years prior to the onset of disability (one additional credit is required for every year in which the worker’s age is greater than 42

In order to apply for a Social Security Disability claim, an individual must provide specific information about how much money they have earned, the names and addresses of businesses they have worked for in the past 15 years, and dates of employment at each of those jobs. Applicants must be able to prove that due to their disability, they cannot execute any type of work in any capacity. However, even when this information is presented, the majority of initial SSDI claims are denied and are required to go before an administrative law judge (ALJ).
