Georgia Supreme Court Overturns Medical Malpractice Damage Cap
Yesterday the Georgia Supreme Court upheld an appellate court decision declaring a legislative cap on noneconomic damages in medical malpractice lawsuits to be unconstitutional. The 2005 law, part of a sweeping tort-reform initiative, declared that a person could not receive more than $350,000 in noneconomic damages, including: "damages for physical and emotional pain, discomfort, anxiety, hardship, distress, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society and companionship, loss of consortium, injury to reputation, and all other nonpecuniary losses of any kind or nature." The specific case involved a woman who suffered infections after a facelift operation, resulting in a long, painful recovery and permanent disfigurement. After a jury trial, she was awarded $1.265 million, which included $1.15 million in noneconomic damages. The lawyers for her facial plastic surgeon said the award should be reduced down to $465,000: $350,000 in noneconomic damages, plus $115,000 in medical expenses.
But the Georgia Supreme Court decided that the original judgment should stand, deciding that the cap on damages was unconstitutional because it infringed on the judicial branch's constitutionally-guaranteed powers. Relying on authorities that predated the Georgia State Constitution, but were cited by the Constitution, including British Common Law, the Supreme Court unanimously decided that the right to a jury trial included the right to have damages determined by that jury. Since both economic and noneconomic damages are considered findings of fact, the Court decided that noneconomic damage caps infringed on the jury's privilege of delivering its verdict. It contrasted these against punitive damages, which are not considered findings of fact.
Noneconomic damage caps are a common form of tort reform, having been implemented in about two-dozen states. In Illinois, last year that state's Supreme Court declared its cap on damages to be unconstitutional, and in many other states the caps continue to face constitutional challenges. For example, read about the challenge to Kansas' noneconomic damage cap, which has yet to be decided.

Eli Lilly Paid Georgia Doctors and Others over Half a Million $ to Promote Drugs
As part of a settlement over the illegal promotion of its best-selling drug Zyprexa, drug-maker Eli Lilly has been required to publish payments it made to doctors and others for patient education, healthcare professional education, and advising. The list, which shows payments made to what it calls "faculty" during the first three months of 2009 shows that it paid over half a million dollars to doctors, nurses, and others to perform educational services for the company.
Although Eli Lilly did not admit wrongdoing (other than a misdemeanor guilty plea) as part of the settlement, the Department of Justice forwarded many charges against the company, including that paid consultants were an essential part of the campaign to promote potentially dangerous side effects as benefits. According to DOJ charges, Lilly used a "5 at 5" slogan to promote the drug as a sedative for nursing home patients, making them easier to handle. In some nursing homes, chemical restraints are a common form of nursing home abuse.
In addition, the DOJ charged that Lilly had a campaign to educate primary care physicians to use Zyprexa as an "everyday agent in primary care," even though these physicians are not generally the ones responsible for treating schizophrenia and bipolar disorder.
Ely Lilly is the first major drug manufacturer to publish fees paid to doctors and others to promote its drugs, but the DOJ has also compelled Pfizer to begin publishing a similar report as part of its $2.3 billion settlement over Bextra, Geodon, Zyvox, and other drugs.
Doctors who take payments and the drug companies that give them claim that they do not influence doctors in prescribing drugs, but it seems unlikely that a corporation would invest over half a million dollars over three months on any practice from which it did not expect to reap some return.

Atlanta Police Search for Driver in Deadly Hit-and-Run Auto Accident
Atlanta police released new information yesterday they hope will help them track down the driver in a deadly hit-and-run auto accident that killed a Cobb County woman March 22. The 47-year-old woman was struck as she was crossing Boulevard in Midtown at Ralph McGill Boulevard, according to Atlanta police. The driver never stopped the vehicle, and is still at large.
Analysis of surveillance video from a nearby gas station showed that the car was a silver or grey four-door Mercedes-Benz, and that the driver was Caucasian or light-skinned African-American. There were no passengers in the car. According to witnesses, the car sustained damage to the right front side and the windshield. Police are offering a reward of up to $2,000 for any information leading to the driver's arrest.

Lawsuit Claims Suicide Was Prompted by Federal Prosecutor’s Relentless Threats
Aaron Danzig, former federal prosecutor told her that he would prosecute her for selling a 2003 Mercedes that the government had targeted for seizure if she didn’t provide the documents he wanted to use in prosecuting her husband. The wife and mother of a one-year-old daughter left a suicide note that read, “I hope Aaron Danzig feels some kind of remorse. I blame him for my struggles with wanting to live.” Terrified of being imprisoned, she shot herself in the head. Danzig resigned his job after the woman’s suicide.
Her now three-year-old daughter’s caretaker filed the wrongful death lawsuit against Danzig on behalf of the child claiming that excessive pressure was used to coerce and intimidate the victim. This case is only one possible example of a wrongful death.
