Traumatic Brain Injuries

At least 1.5 million people suffer from a traumatic brain injury (TBI) each year. TBI can happen as focal injuries such as when a head hits a windshield. This direct impact can cause damage to the area of the brain where the initial contact occurred as well as causing the brain to slam against the skull in the opposite direction of the initial blow. Focal lesions in these areas can be seen on brain imaging in many cases.

Diffuse injury is more of a scattered type of injury which may occur when there is a sudden acceleration and deceleration of the head. This causes the axons in the brain to shear or tear apart causing a more wide-spread injury.

Penetrating injuries occur when the skull and dura matter under the skull are penetrated by an object such as a bullet.

Medical Malpractice
Medical Malpractice occurs when a health care provider breaches or deviates from an accepted standard of care. The standard of care is a medical treatment guideline of how similarly qualified practitioners would have managed the patient’s care under the same or similar circumstances. The standard of care is generally not written in a medical textbook or established in a legal statute. Thus, the determination of whether a particular health care provider breached the standard of care and committed medical malpractice is not an easy task to perform.
Auto/Truck Accidents
79,529 people in Louisiana were injured in automobile accidents in the year 2000. 2,541 of those accidents involved 18-wheeler trucks or buses. 938 people were killed in those crashes. There were 1,101 injuries and 58 fatalities involving motorcycle accidents. Overall, on average, there were 2,841 injuries per 100,000 licensed drivers. Nationwide, these statistics are even more staggering.

 The Federal Motor Carrier Safety Administration (FMCSA) reports that between the years 1990 and 2001 there were approximately 52,278 fatal crashes involving large trucks. For purposes of these statistics, a large truck was defined as a truck with a gross vehicle weight rating greater than 10,000 pounds.
Maritime Accidents

Maritime Accidents may come in many forms. Most are sustained by seamen who are injured aboard a vessel in navigation. A federal law called the Jones Act, allows an employee of a company who is deemed to be a seaman to file a lawsuit against his employer for the negligence of his employer in causing his injury. This is one of the few exceptions to the principle that makes workers’ compensation the only claim available to an injured employee who sustains injury on the job.

Defective products can come in many different forms: defective automobiles, defective medical devices, defective drugs, defective consumer products and many more. A product may also be considered to be defective for many different reasons including: design defect, unfit for intended use, failure to warn, failure to guard, defect in construction, or a defect in materials.
