With the death toll of patients who received the tainted steroid still at 15, cases of fungal meningitis has risen to 205. Tennessee, Michigan and Virginia have been most affected by the outbreak, but vials of the contaminated steroid medication were shipped to 23 states and 76 medical facilities.

Homer "Rock" Herbert, II of Brewton, Alabama, was found not guilty of capital murder September 21, 2012 after standing trial in the death of a 2 year old. In 2011, Herbert had been accused of capital murder after the death of Intrina Johnson, a child who had been left in Herbert’s care by her mother.
