GC Services Wage and Hour Lawsuit Certified as Collective Class Action

On October 6, 2010, the U.S. District Court of Missouri certified this lawsuit as a collective class action wage and hour lawsuit against GC Services for alleged violations of the Fair Labor Standards Act of 1938.

The lawsuit against GC Services, L.P. and GC Services Corporation is seeking unpaid regular and overtime wages on behalf of employees who work in call centers owned by GC Services. These facilities are located in numerous cities in the U.S. The complaint alleges GC Services violated federal and state wage and hour laws by failing to pay its call center employees all regular earned wages and overtime pay. These wages are for the time periods employees were required to perform preparatory duties which are integral and indispensable to their job duties. The lawsuit also alleges that GC Service failed to accurately record all employee time worked pre-shift, post-shift, and during employees' unpaid breaks.

According to the complaint, GC Services denied wages and overtime pay when employees were required to work "off the clock" while logging into and out of computers, accessing computer programs and applications necessary for work duties, and requesting employees to alter time records to avoid or reduce overtime pay. These actions benefited GC Services and therefore, GC Services received unpaid labor from its employees.

Under federal law and the Fair Labor Standards Act, this wage and hour lawsuit was filed by The Cochran Firm and the legal team on behalf of all current and former GC Services call center employees who are or were paid hourly at any GC Services facility in the Unites States.
