The Cochran Firm South Florida Files Claim Against Seaboard Marine, Ltd.

The Cochran Firm South Florida has filed a wrongful death suit in Miami-Dade Circuit Court against Seaboard Marine, Ltd. on behalf of the family of a longshoreman who was killed during a horrific accident at Port of Miami in March.

The lawsuit accuses Seaboard Marine, Ltd. and its cargo vessel, Seaboard Victory, of negligence by claiming failure to utilize safe equipment and failure to conduct basic safety checks and inspection during the off loading of the Victory (a cargo trailer vessel). The suit claims that an absolute failure occurred where Seaboard Marine did not conduct any safety checks or maintenance of its own braking system on the rolling trailer.

According to the lawsuit, during unloading operations at the Port of Miami on the Seaboard Victory, longshoreman Kevin Whyms released a safety chain securing a Seaboard Marine trailer chassis and refrigerated container (50,000 lbs plus) to the deck of the Seaboard Victory (standard discharge operations). However, due to a completely inoperative braking system on the trailer, the chassis suddenly rolled forward, separated from its independent front end support, and collapsed its landing gear. The refrigerated container, suddenly and without any warning, fell directly on Kevin Whyms as he was standing in a crouching position underneath the equipment.

Kevin Whyms, was crushed to death and died within seconds of the refrigerated container violently falling on him. The Seaboard owned and maintained trailer shockingly had absolutely no functional brakes at the time of this tragic accident. Mr. Whyms is survived by his wife, minor child, and several adult children.
