The Cochran Firm has been nationally recognized as The Truck Accident Law Firm of The Year 2020-2021 by Trial Lawyer Magazine and The National Trial Lawyers having obtained over $100 million of verdicts and settlements in truck cases that year alone.

Truck accident cases are often more complex than auto accident cases. Different laws, rules, and regulations apply to semi-trucks, 18-wheelers, and commercial vehicle operations.

Trucking accident lawsuits usually involve multiple parties, including but not limited to the truck driver, the trucking company, cargo companies, defective or dangerous roadways, equipment manufacturers, other negligent drivers, and government entities.

The Cochran Firm utilizes the top trucking experts and engineers in the field of truck accident reconstruction as a resource to assist with and consult on these cases.

Our results in these cases are among the best of any firm in the country and speak for themselves with the hundreds of millions of dollars recovered on behalf of our clients in verdicts and settlements.

Our attorneys have the knowledge and experience to fight against the self-serving tactics of insurance companies and are much more likely to receive the full compensation you deserve.

It is important to contact an experienced attorney as soon as possible. For your free, no-obligation consultation, call The Cochran Firm today.

OVER $30 BILLION RECOVERED IN VERDICTS AND SETTLEMENTS

Auto Collision

Auto Collision

Every day, Americans wake up and commute to their places of employment only to return to their homes or run errands on their way back. On the weekends, especially during the summer months, we road trip to destinations near and far to spend time with our friends or family. It is estimated that in 2023, there were more than 240 million licensed drivers on U.S. roads, and these drivers set a record for miles traveled at over 3.25 trillion miles.

While state, local, and federal laws try to keep us safe on the road, accidents do happen and often result in collisions. In fact, over 35,000 vehicle crashes happen every day in the U.S. While the nature of these collisions varies, many of them result in injury and even death.

When this happens, it is important to hire a law firm that is experienced in litigating car collision cases and has access to knowledgeable healthcare experts who can identify all of the injuries experienced by the victim, even those that are not readily apparent. For example, it is not uncommon for a person to receive a traumatic brain injury during a collision, though the symptoms might not become evident for quite some time.

Causes for vehicle collisions vary greatly but usually involve either operator error, equipment error, impairment of some kind, or a combination of the three. Alarmingly, 30% of collisions and 51% of fatalities involve alcohol-impaired driving. Other common causes can include:

  • Driver Negligence and/or fatigue
  • Dangerous weather conditions
  • Unsafe/ill-maintained road conditions
  • Distracted or aggressive driving
  • Intoxicated/impaired drivers
  • Reckless driving/speeding
  • Debris or other hazards left in the roadway
  • Failure of other drivers to comply with traffic laws
  • Road construction hazards
  • Unsafe/ill-maintained vehicle conditions
  • Improperly secured cargo on a tractor trailer or passenger vehicle with a roof rack or other cargo hauling implement.

When you or a loved one are injured, or worse, in a vehicle collision the attorneys at The Cochran Firm are here to investigate the incident and determine exactly what happened and who is at fault.

$32.9 MILLION JURY VERDICT for an infant who suffered brain damage after an unnecessary premature delivery. The mother received improper medical procedures after a cancer diagnosis during her pregnancy. The infant suffered from respiratory distress and required mechanical ventilation.

$12 MILLION JURY VERDICT awarded to the family of an infant when a medical resident failed to seek the attending doctor’s advice and delayed a cesarean section birth. The infant suffered meconium aspiration and required placement on a heart-lung machine before dying due to infection.

$9 MILLION SETTLEMENT for an infant who suffered hypoxic ischemic encephalopathy, or brain damage, resulting from the doctor’s failure to perform a cesarean section despite the baby’s non-reassuring heart rate, which suggested the baby might not have been getting enough oxygen from the mother’s blood as the baby’s blood passed through the placenta.

Hospitals should be places of healing.

They are where we go when we are hurt or sick and need the aid of well-educated, highly trained, and trusted professionals.

  • According to the Institute of Medicine, each year, nearly 100,000 people die from medical mistakes, yet fewer than 10% of all acts of medical malpractice result in a claim against the doctor or hospital.
  • However, not every bad outcome that a patient experiences is a result of medical malpractice. Bad outcomes are often caused by recognized complications that are not considered malpractice.

At The Cochran Firm, our medical malpractice attorneys have the experience and expertise to help you evaluate and prosecute your medical malpractice case. We often work with experienced medical malpractice attorneys from other Cochran Firm offices across the country to represent our clients at no additional cost to them.

Medical malpractice laws are often designed to protect doctors and hospitals. Many states place caps on the damages that victims of medical malpractice can recover when those same damages are not capped for other personal injuries:

  • Medical malpractice laws require that patients prove they suffered medical malpractice with expert testimony
  • Medical experts are expensive to hire and often difficult to persuade to testify.
  • Once you bring a case, most doctors and hospitals will not readily settle or acknowledge the validity of the claim. Your case requires a trial to resolve.
  • These cases are difficult, expensive, and require special expertise and a qualified lawyer to handle.

An estimated 1.5 million individuals sustain a traumatic brain injury (TBI) each year.  TBI can occur when a victim suffers head trauma, or severe rotational forces which cause them to lose consciousness or be dazed and confused and suffer amnesia, headaches, or other symptoms.  The challenge in diagnosing TBI is to determine the nature, extent, severity, and prognosis for these injuries.

TBI can be classified as mild, moderate, or severe, although there is not a consensus in the medical community on the exact definition of each type and lines between mild and moderate often get blurred.

Many do not realize that although a TBI may be classified as mild, it does not mean that one will fully recover. Many TBI victims go on to suffer life-long cognitive deficits from a mild TBI.

DIAGNOSING TBI

According to the ACRM, a patient with a mild traumatic brain injury (mTBI) has had a traumatically induced physiological disruption of brain function manifested by at least ONE of the following.

  • Any period of loss of consciousness
  • Any loss of memory for events immediately before or after the accident
  • Any alteration in mental state at the time of the accident (eg, feeling dazed, disoriented, or confused)
  • Focal neurological deficits that may or may not be transient, including loss of consciousness or amnesia.

mTBI has become known as the invisible injury because there are often no external signs of injury to the brain and many victims often have subtle or vague symptoms that are confused or mistaken for other problems.

SYMPTOMS MAY  INCLUDE

  • Headaches
  • Memory loss
  • Loss of consciousness
  • Dizziness
  • Visual disturbances
  • Sleep disturbances
  • Irritability
  • Loss of smell
  • Mood swings
  • Concentration Problems
  • Difficulty with focus/attention

Not every patient suffers every symptom, and some symptoms may not appear on the day of the accident. Most mTBI injuries resolve within 3 months, but a growing body of medical literature has shown that up to 50% of mTBI victims continue to experience symptoms up to a year after the incident.

Diagnosing and treating TBI is extremely challenging. Proving it in a court of law is even more challenging. This is why you need a team of experienced TBI lawyers who can help you receive the correct treatment and prove your case to a jury.

Our experienced TBI attorneys at The Cochran Firm have the resources to hire the top healthcare professionals who are trained in diagnosing and treating TBI’s. Understanding TBI medicine is the key to effectively explaining it to the jury.

Our team has produced verdicts and settlements in TBI cases totaling over $50 million in the last 7 years alone. Let us help you get the diagnosis and care you need to recover all of the amounts you are entitled to from this devastating injury.

If you or a loved one has suffered from TBI, please contact the Cochran Firm today for your free, no obligation consultation.

Property owners have certain obligations under local, state, and federal laws to maintain reasonably safe premises under certain conditions and to warn others of any unsafe conditions under certain situations.

When property owners fail to keep their properties safe, innocent people can suffer devastating personal injuries or even death.

Premises liability laws come into play when an injury occurs on someone’s property that was caused because of risky, dangerous, or faulty conditions.
