At a press conference alongside Cochran Firm attorneys, Jor'Dynn Duncan's family announced a $250 million lawsuit and called for answers regarding the failures they say led to her death.

Derek Sells and Mina Malik of The Cochran Firm New York joined the family of 7-year-old Jor'Dynn Duncan to announce the filing of legal claims against Suffolk County and the Bayport-Blue Point School District following the child's tragic death after what prosecutors have described as prolonged abuse and neglect. 

The lawsuit alleges that multiple warning signs regarding Jor'Dynn's welfare were missed or ignored by agencies and individuals responsible for protecting her. According to the claims filed on behalf of her estate, county officials failed to intervene despite repeated indicators that the child was in danger. The family is seeking accountability and answers regarding the circumstances that led to her death. 

Jor'Dynn died on December 29 after suffering what authorities later determined was an untreated infection related to numerous injuries sustained over an extended period of time. Prosecutors have alleged that the abuse was systematic and documented over many months. The Suffolk County Medical Examiner's Office reported that the 7-year-old had approximately 90 injuries on her body at the time of her death. 

Three individuals have been criminally charged in connection with Jor'Dynn's death. Emily Kelly, who had obtained custody of the child in April 2025, has been charged with second-degree murder. Kelly's mother, Barbara Renner, faces a manslaughter charge, while Kelly's daughter, Elyssa Seymore, has been charged with unlawful imprisonment. All three have pleaded not guilty. 

At the recent press conference, Cochran Firm attorneys described the devastating loss and called for a full examination of every agency and institution that had contact with Jor'Dynn before her death, emphasizing that the civil action is intended not only to secure justice for Jor'Dynn, but also to determine whether preventable failures within the child welfare and educational systems contributed to the tragedy.

The legal team is seeking a thorough review of the actions taken by county agencies and other involved entities, as well as accountability for any failures that may have contributed to Jor'Dynn's death. The family hopes the litigation will bring transparency, accountability, and reforms that help safeguard other children in the future.
