Do I Have a Case?

Days Inn swimming pool where 5-year-old Dumfries boy drowned violated Hanover County safety laws

Pool remains closed until hotel manager makes changes

A young child’s life was tragically cut short after staff at a Day’s Inn in Doswell, Virginia near King’s Dominion discovered the victim unconscious in the motel’s pool. The housekeeper immediately called 911 and bystanders tried desperately to revive the child but the boy succumbed to his injuries.

Our thoughts and prayers go out to the victim’s family as they cope with the loss of their beloved son.

“These types of accidents are especially heartbreaking.” Said David E. Haynes, the Managing Attorney of The Cochran Firm, D.C. “I have represented almost a dozen families of drowning victims and experience has shown these accidents are preventable and often attributed to violations of pool safety laws or a lack of adequate supervision on the part of swimming pool operators.”

Doswell Days Inn broke several pool safety codes

Despite the Days Inn manager maintaining the pool’s gate was difficult for adults to open, journalists looking into the tragedy discovered the pool violated Hanover County swimming pool safety laws. According to the county’s building inspector, the swimming pool’s gate violated several local ordinances.

  • The pool gate at the Doswell Days Inn swung towards the pool deck instead of away
  • The latch on the gate was outside the fence, rather than inside the pool area
  • The self-latching gate did not close properly

When ordinary people are hurt because property owners failed to follow safety laws or take reasonable measures to prevent foreseeable injuries, the law gives victims and their families the legal recourse to hold these wrongdoers accountable. Drowning victims and their families may be entitled to substantial compensation for their pain and suffering, mental anguish, burial costs, and medical expenses.
